'via Blog this'RINGGOLD, GA. (WRCB)-- A Ringgold man is recovering in the hospital after being shot in the chest in argument over a weedeater.
Robert Wilson, 37, was shot Saturday afternoon outside of his Karen Drive house by a man hired to do yard work for his next door neighbor.
The Catoosa County Sheriff's Office did not arrest the shooter, who says it was an act of self-defense.
Wilson's family disagrees.
Channel 3 reviewed the police report and talked to eyewitnesses about how it all went down.
"He accused my husband of stealing his weedeater. We went over and helped locate the weed eater. He didn't apologize. He was just really rude," the victim's wife, Christina Wilson says.
Christina Wilson says they found the weedeater next to bushes in their neighbor's yard. That's when her husband Robert Wilson got into an argument with the man hired to do yard work there.
Wilson's family admits he has a criminal record and had been drinking that day, but claims Wilson wasn't being violent and says they're shocked at what happened next.
"He was full aim, both hands, aiming," Christina Wilson says.
"Just pulled a gun on him," the victim's mom, Alice Wilson says.
Channel 3 talked to eyewitnesses off camera who say they saw Wilson walking toward the gunman, when he pulled the trigger.
"He did not go over there to fight the man. He had his hands out. Nothing in his hands," Christina Wilson says.
The bullet punctured Wilson's right lung and went out his back.
"The guy propped on the side of his truck and was watching me hold pressure the whole time to my husband's chest. Didn't say a word, just watched," Christina Wilson says.
"That's wrong. I feel it's attempted murder," Alice Wilson says.
No charges have been filed. The incident report calls this an "aggravated assault with a gun" investigation.
Detectives questioned the shooter, who claimed self defense, and released him.
"How do you claim self-defense when my husband had no weapon, his hands were out, they were a good 10 to 15 feet away from each other," Christina Wilson says.
The sheriff declined an interview, saying the case is still under investigation.
"They just let him go. A shooter. Back on the road again," Christina Wilson says.
Neighbors say Christina and Robert Wilson were screaming at each other just before the incident. They say Christina was telling Robert he was too drunk to drive.
Christina denies that.
Again, the Catoosa County Sheriff's Office says it's still under investigation.
Wilson's family says he's been moved from ICU to a regular room at Erlanger and they're in the process of looking for a lawyer.
