Vencor, Sun Healthcare Groups and Mariner Post-Acute Network, some of the largest chains in the nursing home business declared Chapter 11 bankruptcy in 1999 and January, 2000. These companies own hundreds of nursing homes in nearly every state, involving thousands of residents. Altogether, about 1.5 million Americans live in nursing homes.

Nearly a third of the nursing home revenue in their $87 billion-a-year industry comes from the Federal Government, mostly through Medicare and Medicaid. When Congress passed the Balance the Budget Act of 1997 and trimmed Medicaid expenses, critics say that nursing homes had taken on considerable debt and were deeply mired in extended building projects. Many of the biggest firms saw their stock prices plummet and lost needed capital.
Their woes are compounded by a strong economy and fewer workers. Nursing home salaries are among the lowest for skilled workers. Those charged with most of the patients’ care are paid on average $7.45 an hour.

WATCHDOG EFFORTS ON THE RISE

At the same time, consumer watchdog groups are clamoring for Congress to impose more accountability, some suggesting that cameras be installed in every nursing home room.
The practice of elderly law, evidenced by the membership in the National Academy of Elder Law Attorneys, increased tenfold in recent years to 3,500 members. And support groups for children of the aging have sprouted everywhere.
One result of consumer watchdog efforts is that it's now easier to investigate how nursing homes stack up. The official Medicare site includes a page dedicated to nursing home comparisons:www.medicare.gov/NHCompare/Home.asp
Click on the web site and you’ll be asked to supply a zip code. The page will display all the nursing homes in the zip code with the results of their most recent inspection. Consider that about 40 percent of nursing homes with the most severe deficiencies are repeat offenders. This site makes it possible to weed out those facilities.
Nursing home care averages about $300 a day, which is not enough, industry representatives say, especially for very sick people. The average elderly individual who enters a home runs through his entire assets within six to nine months. At that point he’ll become a Medicaid patient, dependent on funding from the government. Nursing Home Declares Bankruptcy To Avoid Paying Nursing Home Abuse Verdict

A California nursing home owner has taken a uniquely reprehensible approach to avoiding paying a jury verdict. By declaring bankruptcy before the jury returned with the damages award, the operator hopes to avoid payment and “skip town” with all assets intact.


What’s more, he made no secret of his plan. According to the attorneys for the plaintiff
“San Marino Manor Inc. shareholder Erwin Cablayan and their legal team repeatedly attempted to stave off litigation by telling us he runs the nursing home without insurance. We have been tracking for about three to four months how they began transferring assets to a shell corporation.”
The nursing home was operating without insurance, a flagrant violation of state laws. It’s a testament to the sorry state of nursing home regulation that the nursing home was ever allowed to house a single resident.
The victim in this case was a elderly woman who entered the nursing home in 2005. While there she developed numerous pressure sores that were hidden from her family. In addition, the nursing home failed to provide her prescribed medications and also falsified her medical records.
It’s a truly disgusting tale, but unfortunately, it’s only unique in the details. Nursing home abuse and neglect effects every state and nation. While a high rating is no guarantee against abuse or neglect, it’s a good place to start.
.... according to the state’s own data, citations are uncommon. From 2002-2008, there were 218 hearings regarding nursing home evictions. Residents won 147 of them. But the Department of Public Health issued only 40 citations.
Lundeen insists his Department is doing everything it can under the law. ....told her they couldn’t take her back. Jimno said they told her friend, “We no longer want her things here, they are going to be put out on the street. I was a bit confused because I didn’t do anything.”
Jimno had a right to be confused. California law states nursing homes have to save a bed for seven days if a resident needs to go to the hospital. And Jimno was ready to come back well within that time. At a state hearing, a judge even ruled the nursing home had to readmit her. But she still wasn’t allowed back in.
“It’s probably been the number one area of concern,” says Tony Chicotel, an attorney with California Advocates for Nursing Home Reform.
Chicotel said nursing home evictions are getting more common, especially for patients on Medi-Cal, which has the lowest re-imbursement rate.
“There’s roughly 75 to 90 hearings per year. My guess is for every one hearing there’s at least ten, maybe twenty, thirty residents who are essentially dumped,” Chicotel said.
