'via Blog this'As the American Civil Liberties Union's David Shapiro documented last year, the exploding market for private correctional services to run federal immigration detention centers has kept CCA flush, helping the company net some $1.7 billion in 2010. And with the Obama administration deporting undocumented immigrants in record numbers, the demand for building and operating immigration detention facilities has never been greater.
The case against CCA is strong. In 2009, a spate of allegations of sexual abuse at the CCA-run Otter Creek Correctional Facility in Kentucky prompted Hawaii officials to remove the 168 female inmates it was housing there. Last year, the ACLU of Texas sued CCA after an officer at one of its units was accused of allegedly sexually abusing several immigration detainees. And in 2011, reports surfaced of horrific violence at a CCA facility in Idaho, which inmates had dubbed the "Gladiator School."
E-mails obtained by the American Independent suggest that CCA appears to have been keenly aware of the negative perception surrounding its projects, and sought to reassure Crete officials from the outset. Representatives of both parties regularly traded links to news stories and PDFs of protest pamphlets and fliers, in an effort to track the rising tide of opposition to the facility.

That lawsuit settled out of court, but the settlement did not preclude prisoners from filing individual cases against CCA.  Clevenger claims in his suit that CCA officials knowingly put him at risk by housing him with known gang members; shortly thereafter he was assaulted, resulting in a broken tooth, fractured eye socket, and partially torn ear.  I'll go so far as to say that when someone's injuries sound like the aftermath of a fight with Mike Tyson, the violence is pretty severe.




Through never-before-seen images and intimate audio interviews, this exhibit opens a conversation with the broader public. It does not glorify or demonize gangs, but rather challenges widely held views of gang members as unredeemable thugs by demonstrating the efforts of CVL to rise above their circumstances and fight for the life of their community.

Next, I have a couple of questions for those who claim to be working in the anti-rape field and insist that RJ puts survivors “lives at risk.” What is the percentage of sexual assaults that are reported to the police? The correct answer is 54%. That means that 46% of rape victims DO NOT report to law enforcement and the younger you are when you are assaulted the LESS LIKELY you are to report to the cops. What percentage of rapists do you think will ever spend a day in prison? The answer is 3%. You read that correctly… 97% of rapists will NEVER spend a day in prison. So the reality is that just over half of victims of sexual assault turn to the criminal legal system in the first place and most rapists will not go to prison. So a huge chunk of survivors do not turn to law enforcement for whatever reasons and the vast majority of rapists are not behind bars. If your goal is to end rape through a criminal legal process then I would say that based on the numbers, the strategy has already failed.

CCA operates more than 60 prisons across the U.S.[16]
The T. Don Hutto Residential Center, a former medium-security prison in Taylor, Texas, which, from 2006–2009, held immigrant detainees, under a pass-through contract with Immigration and Customs Enforcement (ICE) division of Homeland Security.[17] On August 6, 2009, federal officials announced that T. Don Hutto would no longer house immigrant families.[18]Instead, only female detainees will be housed there. In September 2009, the last families left the facility and were moved to the much smaller Berks Family Residential Center in Pennsylvania.[19]

Corrections Corporation of America(NYSECXW) (CCA) is a company that owns and manages prisons and detention centers and operates others on a concession basis. The company is the largest private corrections company in the United States and manages more than 60 facilities with a designed capacity of 90,000 beds. CCA, incorporated in 1983 by three businessmen with experience in government and corrections, is based inNashville, Tennessee.[2]


Occupancy and profitability

Traded on the New York Stock Exchange, investors in CCA stock have an interest in keeping private prisons filled. Industry experts say a profitable prison must have a 90-95 percent capacity rate. In a 1990s report, Prudential Securities was bullish on CCA but noted, "It takes time to bring inmate population levels up to where they cover costs. Low occupancy is a drag on profits... company earnings would be strong if CCA succeeded in ramp(ing) up population levels in its new facilities at an acceptable rate".
In an April, 2012, program about the American Legislative Exchange Council (ALEC) produced by To the Point and broadcast on NPR stations, it was reported that CCA in combination with ALEC had drafted model legislation which, if enacted into law, would have guaranteed that CCA prisons would be filled to at least 95% capacity.[22]

[edit]Treatment of inmates and disclosure of oversight

Responding to an inmate's death in 2006 at CCA's immigration jail in Eloy, Arizona, government investigators found the medical care provided meant that "detainee welfare is in jeopardy". A subsequent inmate death at the facility resulted in an additional inquiry and "another scathing report", according to the New York Times.[23]
Lack of disclosure from government officials charged with overseeing the care provided resulted in an August, 2009, ACLU litigation. This resulted in disclosure by the Obama administration that 1 in 10 deaths among inmates in immigration detention facilities had been omitted from a list of deaths presented to Congress earlier that year. Two of those deaths took place at CCA's Eloy Detention Center.[24] CCA's Eloy jail had nine known fatalities — more than any other immigration jail under contract to the federal government according to documents obtained in 2009 under FOIArequests by the New York Times and American Civil Liberties Union (ACLU).[24]
In March 2010, The ACLU filed suit against CCA in Idaho alleging that guards are not protecting inmates from other violent inmates.[25]
As of December 1, 2010 the corporation was being investigated by the FBI for an incident at their prison in Idaho Correctional Center. A video released by the Associated Press that shows a prison inmate being beaten unconscious with guards watching not taking action. Because the matter is currently under litigation, the company has only said publicly that the release of the video is "an unnecessary security risk to our staff, the inmates entrusted to our care and ultimately to the public." CCA says it is cooperating with investigators.[26]

[edit]Lobbying efforts

CCA lobbyists have worked to pass or defeat private prison legislation in many localities, including Texas, New York, Illinois and Tennessee.[27]
According to the Boston Phoenix, CCA spent more than $2.7 million from 2006 through September 2008 on lobbying for stricter laws.[28] CCA responded that it does not lobby lawmakers to increase jail time or push for longer sentences under any circumstance, noting that it "educates officials on the benefits of public-private partnership but does not lobby on crime and sentencing policies."[29]
CCA spent $14.8 million lobbying the Department of Homeland Security, U.S. Immigrations and Customs Enforcement (ICE), the Office of Management and Budget, the Bureau of Prisons, both houses of Congress, and others between 2003 and 2010.[29]

In 2004, a disturbance at Crowley County Correctional Facility in Olney Springs, Colorado resulted in more than a dozen inmate injuries.[30] A state audit of private prisons conducted as a result of the riot faulted the Colorado Department of Corrections for not adequately monitoring contract prisons.[31]
An October 2011 riot at CCA-operated North Fork Correctional Facility inSayre, Oklahoma left 46 inmates injured. According to a statement issued by the company in May 2012, 19 inmates would face "attempted murder" charges for assaults committed during the unrest, however, Beckham County District Attorney Dennis Smith disputed that number, noting that Oklahoma does not have an attempted murder statute.[32]
In May 2012 a riot at CCA-operated Adams County Correctional Facility inNatchez, Mississippi claimed the life of a guard and left sixteen staff members and three prisoners injured. Twenty-five employees were held hostage during the disturbance which was ultimately quelled by facility staff with assistance from the Mississippi Highway Patrol and the Federal Bureau of Prisons.[33] According to a company statement, the fatality was only the second time in CCA's history in which an employee had "lost his life to inmate assault."[34]
