'via Blog this'(WMC-TV) - A convicted murderer is hoping to have his execution delayed but he is not getting much support.
The Mississippi attorney general recommended the execution, which is set for June 12, go on as planned.
Eleven years ago, the small community of Sarah, Mississippi, was ransacked by a violent mass murder at the hands of Jan Michael Brawner.
A jury convicted him of killing his ex-wife, her parents, and his 3-year-old daughter. Next week, he is scheduled to die by lethal injection.
The death row inmate now wants a new hearing but The Mississippi Supreme Court ruled four to four earlier this week against it.
In court procedures, a tie vote usually means an earlier ruling stands, but Brawner's lawyers argue there is precedent in Mississippi that says a tie vote in death penalty cases should favor the condemned inmate.
Brawner, who is now 34 years old, blames his lawyers on past appeals and wants an oral hearing on the case.
Time is running out for the governor to grant a stay of execution.
Brawner's execution date is scheduled for June 12.
