According to Lamb, Shchirskiy submitted "suspected false" W-2 forms listing each of the taxpayers as employees of the California State In-Home Support Services agency, or IHSS. The IHSS program pays people to work as caregivers for their elderly family members.
The refund requests sought more than $100,000, and the IRS wound up paying about $63,000 of those refunds.
According to Lamb's affidavit, four of the 12 tax refunds were sent directly to Shchirskiy's bank account at the Ukrainian Federal Credit Union, which has a branch in Citrus Heights. Lamb said the rest of the payments went to other accounts whose owners have not yet been identified.
Danny Brace Jr., Shchirskiy's lawyer, said he's aware that a search of his client's residence had been conducted but had no comment on that part of the identity theft and tax fraud investigation since his client has not been charged in those cases.
Brace added that Shchirskiy pleaded not guilty to the wire and mail fraud charges stemming from the mortgage fraud case. Among the dozens of people indicted in the mortgage fraud case, Shchirskiy is the only person who is still under federal custody. All the others are out on bail.
That's because federal immigration officials recently issued a deportation warrant due to Shchirskiy's 2005 conviction on the state extortion charge.
